TERMS & CONDITIONS:
In the Terms and Conditions the following definitions apply:
a) “Company” means The Paw Studio.
b) “Studio User” means any person that has purchased or made use of one of our yoga classes.
c) “Studio” means any and all of the physical spaces that are occupied and part of The Paw Studio, this includes yoga studios, reception and sitting area, change rooms, corridors, office, and all storage and team areas.
d) “Yoga packages” means any item that provides the client with access to our products/services or studio facilities.
e) “Products/services or studio facilities” means any of the yoga studios open to, or products/services offered to clients of the company as published on our website(s).
f) “Terms and Conditions” are as defined here.
g) “Website” means www.thepawstudio.co.uk or affiliated websites.
The Terms and Conditions are incorporated into the online booking system.
The Company reserves the right to vary or revoke any of the Terms and Conditions from time to time which it may consider necessary or suitable for the regulation of the governance of the studio and the conduct of members. Any such changes will be published on our websites and, until revoked, are binding on members.
The Terms and Conditions shall be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.
CLASS BOOKING, ARRIVAL & LATENESS POLICY:
Classes can be booked online up to three months in advance. We recommend arriving at the studio 5 minutes before the class.
LATE CANCELLATION/NO SHOW POLICY:
All tickets are final price and non-refundable. Late cancellation or a no-show will not be refunded. In rare circumstances where a refund is issued, a small processing fee will be taken at the discretion of The Paw Studio.
You are able to attend any of our classes if you are 16 and above. Those aged 13 and over are permitted into classes with a parent or guardian aged 18+. Anyone under the age of 13 is unable to participate in classes run by The Paw Studio.
All children under the age of 16 years are the responsibility of the accompanying adult when in the Studio premises.
FUNCTIONING OF OUR SERVICE:
The Paw Studio reserves the right to vary the class schedule and opening hours. These changes to the schedule will be published on www.thepawstudio.co.uk.
We do not guarantee that the Service will be uninterrupted or error-free. We are entitled, without notice and without liability (a) to suspend the Service for repair, maintenance, improvement or other technical reason and (b) to make changes to the Service.
You acknowledge that technology is not always secure and you accept the risks inherent in use of the Internet or other technology for the purpose of the Service.
In the event of The Paw Studio cancelling a class, a full refund payment will be issued minus a small processing fee taken by our payment processor. We will not, however, compensate for airfare or travel costs incurred due to class cancellation. In the unlikely event that we must cancel a class due to force majeure (including but not limited to; weather, natural disaster or political upheaval) we cannot guarantee a refund.
Cancellation of classes sessions due to unforeseen circumstances may occur. The Paw Studio reserves the right to cancel classes due to unforeseen circumstances that may occur. The Paw Studio reserves the right, at its discretion, to change or modify the schedule or offer usage of a different studio/location. Our minimum class size is 10 attendees. In the unlikely event that the minimum number is not met, we shall email all those that have purchased a ticket at least 48 hours before the class and re-arrange for a different session.
The names of the tickets holders are checked before the class. The Company reserves the right to refuse a customer whose name is not registered on our system.
Personal belongings are brought in the studio premises at the participant’s risk and The Paw Studio does not accept liability for any loss or damage whatsoever to such items.
For security reasons participants are advised to avoid bringing valuables to the class.
FITNESS & HEALTH:
Participants are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. The Paw Studio reserves the right to refuse access to any participant if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such facilities. Participants with the following conditions, but not limited to, should not attend class: low/high blood pressure, cardiac irregularities, surgery, and sprains or fractures. If there is any doubt, the participant should consult his/her healthcare provider first.
SAFETY & HYGIENE:
Smoking is not allowed anywhere on the premises. No crockery, glass or food is permitted in the changing rooms or yoga studio(s). Studio Users are requested not to walk around the Studio, changing rooms or showers barefoot if they have foot complaints (please wear flip flops). If you have any contagious foot complaints, please make sure you are wearing socks at all times.
The Paw Studio accepts no responsibility for any client who does not follow the instructed class or has not disclosed medical conditions or recent injuries to the teacher. Please be aware that it is your responsibility to inform the instructor if you feel unwell or any discomfort.
If you find that you are pregnant, please let us know as soon as possible as our classes may not be suitable for you. If you choose not to tell us or the teacher about your pregnancy, The Paw Studio will accept no responsibility for any injuries or issues that may occur as a result of doing a class.
Studio Users must use the appointed entrance to the Studio when entering or leaving the Studio. Fire exits, which are clearly marked, are there in the interests of safety and Members must not interfere with these doors for any reason. In the event of a fire, Studio Users are asked to make their way to the nearest available exit.
Studio Users must at all times observe the Studio guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the smooth operation of the Studio for the convenience of all Studio Users.
Studio Users are required to give written notice to the Company of any change of address, email or contact number. Failing such notice, all communications shall be assumed to have been received by the Member within 5 days of mailing to the last address notified to the Company. You can update your details by contacting firstname.lastname@example.org.
The Company reserves the right to refuse admission to the Studio. A person who is not a Member or Studio User has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any terms of the Membership agreement or use any of the facilities provided by the company.
The Company may, if a Studio User so wishes, communicate with the Studio User by electronic mail (“email”). By providing an email address to the Company, the Studio User consents to receiving email communications from the Company, including notices pursuant to the Terms and Conditions. The Studio User also accepts any risk that email may not be a fully secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Member in this manner.
LIMITATION OF LIABILITY:
The Company cannot be held responsible for any service or equipment not being available for whatever reason. The Company reserves the right to make alterations to the types of facilities provided, without notice and in its absolute discretion and the Company shall not be liable for any loss occasioned by such alterations except insofar as loss is by law, incapable of exclusion.
It is the Studio User’s responsibility to ensure that they are capable of undergoing a routine of exercises provided by any programme that they follow or class that they attend. Studio Users accept the risk of injury from performing exercises and are advised to consult their doctor prior to beginning any programme or class. The Company accepts no liability for loss or damage to property or injury of Studio Users on the Studio premises or outside the Studio except insofar as such loss, damage, or injury is by law incapable of exclusion.
PERSONAL INFORMATION & DATA PROTECTION:
Your personal information is secure and usage of your personal information is administered by The Paw Studio, which is part of these Terms & Conditions. We will use your personal information to provide you with use of our products, services and facilities as well as maintain our records, process applications and payments, verify your identity, do market research and gain feedback. Your information may be kept for a reasonable amount of time for the above reasons. Your information may be shared with third parties to comply with our legal or regulatory obligations, for the prevention of fraud or other crimes, and in the case of medical emergencies. By agreeing to our terms & conditions, you consent to the use of your information including sensitive information relating to your health & fitness, for the reasons & manner explained above.
CONSENT TO PHOTOGRAPHY/VIDEOGRAPHY
You provide consent for your videos and/or photos to be used for display purposes, printed publications, or on The Paw Studio’s website and social media pages. If you do not wish to provide consent, please email email@example.com prior to attending a class. If you have not emailed us and have purchased a ticket, we will assume you have provided consent to video/photography.
ACCEPTABLE USE OF OUR SERVICE
You agree not to do any of the following in connection with the Service:
a) breach any applicable law, regulation or code of conduct;
b) use the Service to provide a similar service to third parties or otherwise with a view to competing with us;
c) use the Service for junk mail, spam, pyramid or similar or fraudulent schemes;
d) do anything which may have the effect of disrupting the Service including denial of service attacks, worms, viruses, software bombs or mass mailings;
e) do anything which may negatively affect other Users’ enjoyment of the Service;
f) gain unauthorised access to any part of the Service or equipment used to provide the Service;
g) intercept or modify communications to or from the Service;
h) circumvent any security or other features of the Service including features that restrict use or copying of Content; or
i) attempt, encourage or assist any of the above.
You agree to:
a) comply with any rules or requirements on our Service;
b) promptly comply with any reasonable request or instruction by us in connection with the Service; and
c) ensure that any contact or other information which you supply to us is accurate and not misleading and you will tell us if there are any important changes.
You are responsible for your Content. We reserve the right without notice or refund to reject, suspend, alter, remove or delete Content or to disclose to the police or other relevant authorities or to a complainant any Content or behaviour if it is the subject of complaint or where we have reason to believe that it breaches our terms and conditions, or that such steps are necessary to protect us or others, or that a criminal offence may have been committed, or where required by law or where requested by the police or other appropriate authorities, or if we consider that Content does not meet our quality standards. If so, you must not attempt to re-publish or re-send the relevant Content.
OTHER PEOPLES’ SERVICES / ADVERTISING / WEBSITES
We may display other peoples’ services, advertising and /or links to other websites. We do not recommend or endorse, nor are we legally responsible for, any of these. You use them at your own risk.
RESTRICTIONS ON OUR LEGAL RESPONSIBILITY
Nothing in this agreement in any way limits or excludes our liability for negligence causing death or personal injury or for fraud or fraudulent misrepresentation or for anything which may not legally be excluded or limited. In this section, any reference to us includes our employees and agents, who have the right to enforce this agreement.
We shall not be liable for any loss or damage where:
a) there is no breach of a legal duty owed to you by us;
b) such loss or damage was not reasonably foreseeable (meaning it was not an obvious consequence of our breach or not contemplated by you and us at the time we entered into this contract);
c) (and to the extent that) such loss or damage is your fault, for example by not complying with this agreement; or
d) such loss or damage relates to a business of yours.
You will be liable for any reasonably foreseeable loss or damage we suffer including claims made by other people arising from your breach of this agreement or misuse of our Service (subject of course to our obligation to mitigate any losses).
INTELLECTUAL PROPERTY RIGHTS
The intellectual property rights in all material used on or in connection with our Service (including the videos) are owned by us or by our partners. For your personal use only, you may view such material on your device. You must not otherwise use such material including copying, publishing, selling or adapting it or taking extracts from it without our specific prior written consent. You must not misrepresent the ownership or source of such material, for example by changing or removing any legal notices or author attributions.
You must not collect, scrape, harvest, frame or deep-link to any Content on our Service without our specific prior written consent.
You acknowledge and agree that we may process your personal information in accordance with the terms of our privacy and cookies policy on our website, which is subject to change from time to time.
